HUD Awards $36 Million in Grants to Prevent Foreclosure Actions

The US Department of Housing amp; Urban Development (HUD) has awarded more than $36 million in grants to hundreds of national, regional and local organizations to help families and individuals with their housing needs and to prevent future foreclosures. HUD's housing counseling grants and the additional funding they help to leverage will assist more than 1.5 million households find housing, make more informed housing choices, or keep their current homes.

HUD is also establishing a new Housing Counseling Federal Advisory Committee to help the Department provide consumers with the knowledge they need to find and sustain decent housing. The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 requires HUD's Secretary to appoint no more than 12 individuals from various backgrounds to offer advice to the Department regarding the functions of the Office of Housing Counseling.

"Access to knowledge and information is vital to every family's success," said HUD Secretary Julián Castro. "These grants will expand housing opportunities for families across our nation. The evidence is clear: housing counseling works. We look forward to working with our housing counseling partners to empower American families with the tools to prosper."

More than $34 million will directly support the housing counseling services provided by 29 national and regional organizations, six multi-state organizations, 20 State Housing Finance Agencies (SHFAs) and 215 local housing counseling agencies. In addition, HUD is awarding $2 million to three national organizations to train housing counselors who will receive the instruction and certification necessary to effectively assist families with their housing needs.

The comprehensive housing counseling housing grants announced were competed through the Department's two-year (FY2014-FY2015) Comprehensive Housing Counseling Grant Program Notice of Funding Availability (NOFA) published March 4, 2014. On April 2, 2015, HUD published a FY 2015 Supplemental NOFA that makes FY2015 funding available to eligible housing counseling agencies that did not receive funding in the awards announced. 

National and regional agencies distribute much of HUD's housing counseling grant funding to community-based organizations that assist low- and moderate-income families to improve their housing conditions. In addition, these larger organizations help improve the quality of housing counseling services and enhance coordination among counseling providers.

Recent research from the Federal Reserve Bank of Philadelphia and the Urban Institute continues to find substantial benefits to housing counseling for families who purchase their first homes and those struggling to prevent foreclosure.

Judge Rules Wells Fargo Breached Terms of 2010 Mortgage Settlement

A federal judge ruled this week that Wells Fargo breached a nationwide 2010 settlement involving adjustable-rate mortgages, saying that the bank denied assistance to borrowers who were seeking loss mitigation solutions, according to multiple media reports.

The lawyers representing the homeowners were contending that Wells Fargo failed to properly evaluate thousands of borrowers who were at imminent risk of default for loan modifications or other type of assistance to prevent foreclosure, and that the bank used the wrong methods to determine financial hardship on the part of the borrowers. The San Francisco-based bank had agreed to grant loan modifications potentially worth up to $2.7 billion, according to the 2010 settlement. The original settlement also called for the bank to pay class members a total of $50 million.

Judge Richard Seeborg, in the US District Court of Northern California, ruled that Wells Fargo had breached the terms of the settlement by using evolving and perhaps ill-defined standards when determining borrowers eligibility for a loan modification, according to one report. At the same time, however, Seeborg told both sides they had had almost no idea what they agreed to in the settlement.

Were very pleased, Jeffrey Berns, counsel for the plaintiffs, told DS News. The court has found on three separate occasions that Wells Fargo breached the settlement agreement - in reporting, pre-screening, and now imminent threat of default. And its only the beginning. Were hoping that Wells Fargo will do the right thing.

Seeborg instructed representatives from Wells Fargo to meet with the homeowners and determine a way to correct the violations, which may include allowing some homeowners to reapply for loan modifications. The judge gave both sides two weeks to submit either joint or competing proposals, according to the report.

Wells Fargo spokesman Tom Goyda told DS News in an email that we are reviewing the decision and will be working to provide the judge with the additional information he has requested.

The original 2010 settlement resolved complaints over Wachovias portfolio of pick-a-payment loans which Wells Fargo inherited when it acquired Wachovia for $15.1 billion in 2008. The pick-a-payment loans originally provided borrowers with lower mortgage payments, but adjustable rates later caused payments to escalate, resulting in massive defaults that led to the nationwide financial crisis.

Berns, of the Woodland Hills, California-based firm Berns Weiss, said his firm planned to bring at least three more cases to the court in which they believe Wells Fargo is guilty of breaching the terms of the settlement.
